Abstract

With the continuous development of internet technology, the emerging workforce of gig workers has arisen. While gig workers meet the demands of societal progress and provide significant convenience to daily life, the inherent lag in legal frameworks has resulted in the absence of comprehensive legislation to regulate and safeguard their labor rights. Consequently, the inadequate protection of gig workers’ rights has become a focal concern in legal scholarship. Against this backdrop, this paper explores the systemic challenges in protecting gig workers’ labor rights and conducts an in-depth analysis of these issues. Through questionnaire surveys, literature reviews, and comparative analysis, this study identifies root causes and proposes targeted policy recommendations. First, it is imperative to expand and refine the criteria for determining employment relationships. Second, China’s current insurance system requires reform to align with the unique characteristics of gig work. Finally, governments should strengthen regulatory oversight, and labor unions ought to innovate membership mechanisms and service models to collectively ensure the protection of gig workers’ rights.
